01. Acceptance of Terms
By accessing ninacapone.com (the "Site"), purchasing a product, or subscribing to the Inner Circle paid membership, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site. Nina Capone Media may update these Terms from time to time; the "Last Updated" date above reflects the most recent revision.
02. Eligibility
You must be at least 13 years old to use the Site and at least 18 (or the age of majority in your jurisdiction) to purchase a paid Inner Circle membership or any physical merchandise. By submitting payment, you represent that the information you provide is accurate and that you are authorized to use the payment method.
03. Inner Circle Membership
The paid Inner Circle membership is billed monthly at the stated price (currently US$20/month) through Stripe. Your subscription renews automatically each month until you cancel. You can cancel any time through the Stripe Customer Portal — your access continues until the end of the current billing period. We do not pro-rate partial months. See the Refund Policy for our specific stance on refunds.
04. Backstage Live Access
Backstage live sessions on Be.Live are reserved for active paid Inner Circle members. The join URL is shared on the /backstage page after we verify your membership email. The link is for personal use only — do not share, screen-share, or rebroadcast the stream. Recording the live session in part or whole is prohibited without prior written consent.
05. Content & Intellectual Property
All music, audio, video, written content, photography, and brand identity on this Site are owned by Nina Capone Media or its licensors. You may stream and share links to publicly posted content. You may not download, copy, redistribute, modify, sample, or commercially exploit any work without an explicit written license. Fair-use commentary and editorial citation are welcome.
06. User-Submitted Content
Fan mail (text and voice notes), story submissions, and bookings inquiries are private and reviewed by Nina Capone Media. We will not publicly display your message, name, or contact info without your prior consent. By submitting, you grant us a non-exclusive, perpetual license to use the content internally and, with your consent, to feature you in newsletters or social posts.
07. Prohibited Conduct
Do not use the Site to: (a) harass, threaten, or harm anyone; (b) upload audio, photos, or text containing hate speech, sexually explicit material involving minors, or content that infringes third-party rights; (c) attempt to bypass our authentication or payment systems; (d) scrape, crawl, or load-test the Site without permission. We reserve the right to revoke memberships and ban accounts that violate these rules — no refund for terminated abusive accounts.
08. Disclaimers
The Site and all content are provided "as is" without warranty of any kind. We do not guarantee uninterrupted access, error-free streams, or compatibility with every device. Our wellness blog posts are editorial and not medical, legal, or financial advice — consult a licensed professional for personal decisions.
09. Limitation of Liability
To the maximum extent permitted by law, Nina Capone Media and its agents are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, even if advised of the possibility. Our total aggregate liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
10. Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws principles. Any dispute will be resolved by binding arbitration in Philadelphia, PA, except that either party may bring a small-claims action in their local court. You waive any right to participate in a class action.
